DP Enrichment: Age-Out & Domestic Staff Sponsorship

Advanced guide on children reaching the age limit and hiring staff.

The Hierarchy of Sponsorship

The Dependant Pass (DP) is a derivative pass tied directly to the principal Employment Pass (EP) holder. It is available only to legal spouses and biological or legally adopted children under 18 (or under 25 if still in full-time education). The DP's validity is always synchronized with the principal's EP.

Consular Attestation Mandates

Document Legalization: Marriage and birth certificates must be 'Attested' by the Ministry of Foreign Affairs (MoFA) in your home country and then by the Malaysian Embassy. For French nationals, this involves the French Ministry of Foreign Affairs and the Malaysian Embassy in Paris.

Education Rights: DP holders are legally permitted to enroll in international or private schools in Malaysia without requiring a separate Student Pass. They only need an 'Education Endorsement' in their passport.

Work Rights for Spouses: Spouses of EP Category 1 holders can work in Malaysia by obtaining a 'Permission to Work' endorsement. This is a streamlined process compared to applying for a full EP.

The 'Age-Out' Protocol

Once a child reaches 18, they are no longer eligible for a DP unless they are enrolled in tertiary education. If they are not students, they must apply for an LTSVP, which is subject to annual approval and does not grant automatic work rights.

Rights to Hire Domestic Staff

An EP holder, as the principal sponsor of the household, has the legal right to sponsor a foreign domestic helper. It is important to note that DP holders cannot act as primary sponsors for domestic staff; the contract must be in the name of the principal EP holder.
